You make the statement that the photos are the copywrited property of the person who took the photo and may not be used or reproduced without their consent.
Do those People with nothing better to do than invade others privacy, first obtain permission to photograph and then publish privately owned and operated aircraft, possibly for financial reward?
It maybe an interesting debate in court.
If I took photos of your home and the coming and going of the people who lived there I’m sure you would call the police, your website is no different.
Hi Brad,
This intent of this website is to encourage interest in aviation in Western Australia. We share news and information to educate and inform people about aviation, assist the aviation industry and its clients. We also enjoy photographing aircraft as a hobby and an art, as well as to record Western Australia’s aviation history. We see this to be an enjoyable, safe and harmless activity.
Aircraft photography is a lawful practice, with some restrictions regarding photography of military aircraft.
There is no intention to “invade privacy”. We take photos of the aircraft themselves and have no interest in who is aboard. Federal and State Privacy Acts are limited to the regulation of Government Departments and large corporations. Therefore, current privacy legislation does not apply to the taking and displaying of photographs by individuals.
With regard to the financial reward aspects, we are a non-profit group. If a photographer was taking photos of people for “commercial use”, then permission has to be obtained from the person depicted in the photo. Note that this does not apply to photos of objects (aircraft). Commercial use means the use of a person’s likeness to endorse a product or service, or to entice others to buy it. Displaying aircraft photos on the website of a non-profit group does not constitute commercial use. Even if one of our photographers was approached to sell one of their aircraft photos, this is still not commercial use.
If you believe that a photo on our website has breached the law, then please specify which photo you’re referring to and which law has been breached, i.e. which section number(s) of which Act.
I am an Aviation professional who has he’d to endure you pests for 25 years, you invade the privacy of individuals and publish them publicly, next time you approach a hanger I’m in you will get a new type of refusal when you try to walk in and take photographs without permission of the owner first.
Have a nice day and consider the potential damage you could do to someone or their business by publishing names and organisations without consent.
I may consider starting a page AerosexualsWA and post photos of your group and your daily movements.
Brad,
I too have worked in the aviation industry and have a pilot’s licence. Our membership includes other pilots and a licenced aircraft maintenance engineer.
Our members do not enter hangars to take photos without permission from someone inside the hangar. I cannot say the same for non-members, who may be the pests that you are referring to.
We do not breach privacy laws. The aircraft register with owner names is already publicly available on the CASA website, just as it is in every other country which believes in freedom and transparency.
During the five years that we have been publishing photos on our website (and there are thousands of photos), this is the first time that someone has complained about this issue. If we have accidentally taken a photo of you, please let me know which photo and I will be sure to blur out your face.
We normally get compliments and requests for photos from the pilots, aircraft owners, or engineers that have worked on a particular aircraft. We also assist the aviation industry by publishing a directory of aircraft fleets – the aviation companies have complimented us on this and it is used by customers of the industry.
